What Is a Claim Chart?

The Anatomy of
an Infringement Argument

A claim chart maps each element of a patent claim — word by word — against the corresponding feature of a product or process. For infringement to exist, every element of at least one claim must be present in the accused product. A claim chart makes that case (or refutes it) with documentary precision.

Claim charts are used in licensing negotiations to demonstrate the strength of a patent position, in litigation to support or defend infringement allegations, in SEP (Standard Essential Patent) proceedings to establish essentiality, and in portfolio transactions to evidence the value of specific patents.
